Using Legal Auto Dialers To Find Customers

It sounds too good to be true – the autodialer dials your list of contacts, and customers call you back just a few minutes later. The question on many peoples’ minds is “Is this really legal?” if you take the time to know the law and follow it, using legal auto dialers to reach your customers can be a dream come true. If you don’t do your homework, it can result in thousands of dollars in legal fees.

First of all, don’t be fooled by services that advertise “legal auto dialer”. There are quite a few laws, both federal and state, that control the use of autodialer equipment, but the equipment has never been outlawed entirely. Contact the FCC office in Washington, DC to get a copy of the 1991 TCPA guidelines that govern cold-call telephone solicitation. You might try contacting your local Public Utility Commission and your State Attorney General for a copy of state guidelines.

The most important federal laws that govern use of your chosen autodialer software are those that pertain to the Do Not Call list. Downloading a copy of the Do Not Call list for the zip codes you are marketing to is an absolute must. Luckily, you can go to the federal website at http://telemarketing.donotcall.gov/ to download the list for as many as five zip codes, free of charge.

The other important regulation is the 2% rule. The FCC and FTC have ruled that  legal auto dialers must not cause more than a 2% call drop for call recipients during your businesses’ daily broadcast of calls.

Most of the other laws regarding autodialers simply formalize a code of etiquette, decency, and respect which your company would probably follow anyway. Learn the laws, and you can expect good results and happy customers from your legal auto dialer.
